Blackbaud Settlement Order

Blackbaud is a third-party, cloud storage company that the Defendants used to store their data. 

On July 16, 2020, Blackbaud disclosed that it had been the victim of a ransomware attack, which had resulted in the exfiltration of a subset of the personal data. Since that time, the Representative Plaintiffs in Ontario and in BC have been unable to point to any instances of harm, including financial or in fact any misuse of the data. Against this backdrop, the parties negotiated a settlement that envisions cy-prés payments, specifically to two Canadian universities.

By way of order of the Ontario Superior Court of Justice, the proposed settlement was approved. The settlement order can be downloaded below.
